Terms of Service

Welcome to Betrothy. These Terms of Service (“Terms”) govern your access to and use of the Betrothy website, mobile applications, and related services (collectively, the “Service”). By creating an account, clicking to accept, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use Betrothy
You must be at least 16 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using Betrothy, you represent that the information you provide is accurate and that you have the right to share any content you post.
2. Your account
You are responsible for safeguarding your password and for any activity on your account. You agree to provide accurate information and to keep it current. Tell us promptly if you suspect unauthorized access by contacting admin@betrothy.com.
3. Acceptable use
You agree to follow our Community Guidelines when using the Service. In particular, you will not:
- Harass, threaten, or harm other people.
- Post content that is unlawful, deceptive, or infringing.
- Impersonate any person or misrepresent your affiliation.
- Scrape, copy, or redistribute the Service in bulk.
- Interfere with the security or integrity of the Service.
4. Your content
You retain ownership of the content you post on Betrothy (photos, posts, messages, wedding details, vendor profiles, etc.). By posting, you grant Betrothy a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, reproduce, and adapt that content solely to operate, promote, and improve the Service.
Some features let you create new content with our tools: designs in the Ring and Dress studios, songs in the Music studio, and AI-generated avatars and cover art. As between you and Betrothy, you own the content you create this way, subject to the rights of any third parties and to Section 7. You are responsible for the inputs you provide (including prompts, photos, and voice recordings) and for making sure you have the right to use them.
You are responsible for the content you post and for any consequences of sharing it.
If you send us suggestions or feedback, you grant Betrothy a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you.
5. Vendors, planners, and bookings
Betrothy is a platform that helps couples connect with planners and vendors. Any agreement to provide or receive services is solely between the parties involved. Betrothy is not a party to those agreements, does not screen or endorse users, and does not guarantee the quality, safety, or legality of any services offered through the Service. Any dispute between users is between those users.
6. Registry gifts and contributions
Betrothy lets guests contribute to a couple's registry. Contributions are processed by our third-party payment provider (Stripe). Betrothy does not hold funds, sell the listed items, or act as the merchant. A contribution is a gift to the couple, not a purchase from Betrothy.
Couples are responsible for the items and experiences they list, and any dispute about a gift, its delivery, or a refund is between the contributor and the couple. Contributions are generally non-refundable once a gift is funded, except where required by law or where the couple agrees otherwise. You agree not to use registry contributions for fraud, money laundering, or any unlawful purpose, and your use of the payment provider is also subject to its terms.
7. Design studios and AI features
Betrothy offers AI-assisted tools, including the Music studio (lyrics, vocals, and composition), the Ring and Dress studios, and AI-generated avatars and cover art. These tools rely on third-party AI providers, and the inputs you submit are shared with them to generate your output (see the Privacy Policy). The planning assistant and Trother (our matchmaker) are AI-assisted features too. Trother is optional; when you turn it on, it finds potential partners from your extended network and emails them to you, and you can turn it off at any time.
AI output can be inaccurate, generic, or similar to output others receive. It is provided “as is,” with no guarantee of originality, fitness for any purpose, or that it is free of third-party rights. You are responsible for reviewing output before you use or share it. You agree not to use these tools to:
- Create content that infringes anyone's copyright, trademark, or other rights.
- Generate a real person's likeness or voice without their consent, or anything deceptive or misleading.
- Produce unlawful, harmful, or adult content.
You must have the rights to any photo, recording, or other input you submit, including your own voice when you record in the Music studio.
8. Fees and payments
Some features may require a paid subscription, and registry contributions are processed through our payment provider. Pricing and billing terms are presented before you pay. Subscription fees are non-refundable except where required by law; registry contributions are handled as described in Section 6.
9. Intellectual property
The Betrothy name, logo, and all software, designs, and interfaces are owned by Betrothy or its licensors. You may not copy, modify, distribute, or create derivative works from any of it without our written permission.
10. Copyright and DMCA
We respect intellectual property and respond to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act (“DMCA”). If you believe content on the Service infringes your copyright, send a notice with the required information (identification of the work, the infringing material and its location, your contact details, a good-faith statement, and your signature) to our copyright agent at admin@betrothy.com. We may remove infringing content and terminate repeat infringers.
11. Termination
You may stop using Betrothy at any time and delete your account from the settings page. We may suspend or terminate your access if you violate these Terms or the Community Guidelines, or if we are required to do so by law. Sections that by their nature should survive termination (including content licenses, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
12. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Betrothy disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service, or any AI-generated output, will be uninterrupted, secure, accurate, or error-free.
13. Limitation of liability
To the fullest extent permitted by law, Betrothy and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars ($100).
14. Indemnification
You agree to defend, indemnify, and hold harmless Betrothy and its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
15. Dispute resolution; arbitration; class-action waiver
Please read this section carefully: it affects your legal rights. Except for small-claims matters and requests for injunctive relief, you and Betrothy agree to resolve any dispute relating to the Service through final and binding individual arbitration, rather than in court, under the rules of a recognized arbitration provider. The Federal Arbitration Act governs the interpretation and enforcement of this section.
Class-action waiver.You and Betrothy agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
30-day opt-out. You may opt out of this arbitration agreement by emailing admin@betrothy.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out does not affect any other part of these Terms.
16. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. To the extent a dispute is not subject to arbitration, it will be resolved exclusively in the state or federal courts located in San Francisco, California, and you consent to their jurisdiction.
17. Changes to these Terms
We may update these Terms from time to time. If changes are material, we'll notify you in the app or by email before they take effect. Continued use of the Service after a change means you accept the updated Terms.
18. General
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full effect. These Terms, together with the Privacy Policy and Community Guidelines, are the entire agreement between you and Betrothy regarding the Service. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver. Neither party is liable for delays or failures caused by events beyond its reasonable control.
